Its economic activity is the provision of wellbeing and health-promotion services, which includes the sale and booking of treatments, massages and rituals, as well as the sale of e-vouchers for these services through the website www.topspa.pt (https://www.topspa.pt/pt).

TOPSPA, Mandalay Spa, CitySpa and BluSpa are registered brands owned and managed by TOPSPA Lda., NIPC: 507383184, with registered office at Rua Gonçalves Zarco No. 19-A 1400-033 Lisbon. TOPSPA operates this site, promoting wellbeing and health, with the booking of treatments and the sale of e-vouchers for massages and rituals through the website www.topspa.pt (https://www.topspa.pt/pt).

Changes to the Terms and Conditions

TOPSPA reserves the right to change these Terms and Conditions at any time. Any changes will be published on the site and users will be notified by email. Continued use of the services after such changes constitutes acceptance of the new Terms and Conditions.

Introduction

Sales of e-vouchers made through the online store www.topspa.pt are subject to the client's acceptance of the General Sales Conditions, in compliance with the applicable e-commerce legislation.

The purchase process is only possible after creating a client account and logging in to the online store.

About the E-Voucher

  • The different massages, treatments and/or rituals purchased through the website always have an associated e-voucher. Both the massages, treatments and/or rituals and the associated e-voucher are available in the listing presented on www.topspa.pt (https://www.topspa.pt/pt), which is regularly updated.
  • The e-voucher gives access to the specific service chosen by the buyer and provided by TOPSPA, when purchased on www.topspa.pt (https://www.topspa.pt/pt). To make the purchase, the buyer must access the store.

The physical e-voucher, called “Voucher”, can also be used at any of the spas managed by TOPSPA for its purchase value — never at other points of sale. It is not available online.

Massages, treatments and rituals purchased through the website have an associated e-voucher. These are listed on www.topspa.pt (https://www.topspa.pt/pt), which is regularly updated.

The e-voucher provides access to the specific service chosen by the user. It can be purchased in the online store or as a "guest".

Validity and Renewal

  • The e-Voucher included with the purchase of massages/treatments and/or rituals is valid for 1 year. The service must be carried out within that period, otherwise the rights granted by the e-Voucher will be irrevocably lost after expiry.
  • Clients should keep proof of payment of the e-Voucher for the validity period indicated above, so that TOPSPA can resolve any issues during activation. Without these documents, TOPSPA cannot resolve any issues that may arise, nor identify the purchase associated with the e-voucher.
  • For e-Vouchers, no renewal or extension of validity is possible after the expiry date. The e-Voucher is automatically cancelled and all rights of use are lost.

The e-Voucher is valid for 1 year. The service must be carried out within that period, otherwise the rights granted will be irrevocably lost after expiry.

Clients must keep proof of payment during this period, so that TOPSPA can resolve any issues during activation. Without these documents, TOPSPA cannot resolve any issues that may arise.

Exchanges

  • During its validity period, the e-Voucher can be exchanged free of charge any number of times, as long as the massages/treatments and/or rituals do not exceed the original value. If the new service is of higher value, the bearer of the e-Voucher must pay the difference at the location.
  • Exchanges of e-Vouchers are handled by the respective Spa. To make an exchange, the bearer must contact the Spa by phone or visit in person.
  • In the event of non-use, loss, theft, or destruction of the e-Voucher, the bearer and/or buyer cannot claim any compensation or use of the voucher.
  • Spa exchanges may occur, provided the new spa to be used is owned and managed by TOPSPA. To exchange, the client must contact the chosen spa by phone or email and request a booking for the same service or a similar value. Each Spa has a specific price list and the same service may have different values at different Spas. If the value exceeds that of the e-Voucher purchased, the bearer of the e-Voucher is responsible for paying the difference.

Cancellation and Booking

  • If the buyer of an e-voucher wishes to cancel or change a booking, they can only do so directly with the respective spa, with a minimum notice — set by TOPSPA's commercial policy — of at least 8 hours before the start of the service.
  • Cancellations not made under the terms set out above will not be processed and will result in the loss of the rights inherent to the e-Voucher in question, in particular regarding new bookings.
  • Once a booking has been made, if the bearer does not attend on the booked date, time and location without having cancelled or changed under the terms above, they will lose all rights inherent to that e-Voucher, including the right to a new booking or the possibility of renewal.

Price and Payment

All prices shown on the TOPSPA site include VAT at the legal rate in force. The accepted payment methods are those specified during the checkout process. TOPSPA makes every effort to ensure the accuracy of the prices shown on the site but reserves the right to correct any errors that may occur.

Restrictions

  • The services provided may require the verification of certain conditions and requirements with regard to the person(s) using them, such as minimum age, state of health, good physical or psychological condition, or other requirements.
  • Booking restrictions are set by TOPSPA, which is responsible for managing reservations and informing buyers/bearers of the "e-Voucher" on the website www.topspa.pt.
  • Any physical and/or mental limitations on the part of users must be expressly mentioned to the therapists at the Spa, as well as to TOPSPA itself when contacted, otherwise the experience may not be possible.

Responsibility of TOPSPA

TOPSPA is an entity whose classification of economic activities includes physical wellbeing, maintenance and repair and other business consulting and management activities — and is licensed to market all activities aimed at the individual consumer that are made available through the website www.topspa.pt (https://www.topspa.pt/pt).

TOPSPA is responsible for any matter related to the organisation, delivery (except for delays attributable to clients), provision and performance of massages/treatments and/or rituals, their booking and/or cancellation or postponement, cases of non-performance or poor performance, as well as any other circumstances or consequences directly or indirectly related to the provision of the experiences.

Suggestions and Complaints

Clients have the right to submit complaints, either through registration of the complaint in the Complaint Book or by lodging a complaint with the regulatory authorities. Our clients can also send suggestions by email to online.store@topspa.pt (mailto:online.store@topspa.pt).

Jurisdiction for consumer disputes

In the case of a consumer dispute, as defined under Law no. 144/2015 of 8 September, as currently worded, the consumer may resort to the competent alternative consumer dispute resolution entity. An up-to-date list of all available alternative consumer dispute resolution entities is available at www.consumidor.pt.

If there is no alternative dispute resolution entity under the terms of the previous paragraph, or if the existing ones are not competent given the value of the dispute, the consumer may resort to the National Centre for Information and Arbitration of Consumer Disputes, located in Lisbon, with the email address geral@cniacc.pt and the page www.cniacc.pt/pt/apresentacao-de-reclamacao (http://www.cniacc.pt/pt/apresentacao-de-reclamacao).

Right of withdrawal – Applicable only to distance sales through the TOPSPA website.

When purchasing an e-Voucher exclusively on www.topspa.pt, the client has the right to withdraw from the purchase within 60 days from the day on which they received the e-Voucher, provided that the service has not yet been carried out.

To exercise the right of withdrawal, you must communicate your decision through an unequivocal statement (for example, a letter sent by post, or an email to the relevant address). The statement may be sent to:

Intellectual property

TOPSPA, Mandalay Spa, BluSpa and CitySpa are registered brands of TOPSPA, Lda. Any unauthorised use or reproduction of the brand is expressly prohibited.

TOPSPA is the exclusive holder of all intellectual property rights reproduced or represented in the e-Voucher and in the presentation and catalogue of experiences on www.topspa.pt, including copyright, personal and patrimonial rights, trade mark rights and logos relating to text, images, software, design, web design, videos, illustrations and other content.

The client agrees to fully respect these rights and to refrain from any acts that could infringe them.

Nothing in these Terms and Conditions should be interpreted as granting a licence to use these intellectual property rights.
